We must note that, by issuing a circular, FINMA is disregarding both Parliament's declared intention to separate civil and supervisory law and the final ruling of the regulatory authority. FINMA is responsible for supervisory law and not for the civil law relationships between financial service providers and their customers. The attempt to subject this area to public law by means of a circular is firmly rejected.
